Most shop and retail workers have the legal right to opt out of Sunday work under the Sunday Trading Act 1994, unless Sunday working is part of their original contract or the business operates in specific sectors (for example, small shops or essential services).

To opt out, the employee must give their employer three months’ written notice. The employer cannot refuse this request or treat the employee unfairly for doing so. After the three-month period ends, the employee cannot be required to work on Sundays unless they later choose to opt back in.
