Under Regulation 11 of the Transfer of Undertakings (Protection of Employment) Regulations 2006 (TUPE), the current employer (transferor) must provide the incoming employer (transferee) with specific employee information — known as Employee Liability Information (ELI). This includes key details such as employee names, terms, pay, disciplinary records, and benefits, ensuring a smooth and legally compliant transfer.

The transferor must supply the ELI at least 28 days before the transfer date. This allows the transferee sufficient time to review the data, identify any potential liabilities, and prepare for consultation, payroll setup, and employee communication in compliance with TUPE law.
