Under Regulation 11(6) of TUPE, if any changes occur to an employee’s terms, status, or circumstances after the initial ELI is issued, the transferor must notify the transferee in writing as soon as reasonably practicable. This ensures the incoming employer has the most accurate and up-to-date employee data before the transfer.

The transferor must report any material change that affects the transferring employees — such as pay adjustments, new starters or leavers, disciplinary or grievance actions, sickness absences, changes to benefits, or variations to contractual terms. Keeping this information current is essential for legal compliance and a smooth handover.
